Conduct: On 6 July 2020, Norbert Talent Marara (“Mr Marara”) caused NTM Drainage Limited (“NTM”) to breach the terms of the Bounce Bank Loan (“BBL”) scheme by overstating NTM’s turnover when applying for a BBL of £50,000, to which it was not entitled. Furthermore, BBL funds totalling £34,520.50 were not used for the economic benefit of NTM. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover for the calendar year 2019. The turnover figure was self-certified by the applicant. • NTM was incorporated on 7 November 2016 and commenced trading on that date. • On 6 July 2020, Mr Marara applied for a BBL of £50,000 on behalf of NTM declaring that its turnover for the calendar year 2019 was £225,767. The BBL agreement was signed by Mr Marara on 24 July 2020. Mr Marara knew or ought to have known the turnover figure stated in the BBL application was an overstatement of NTM’s actual or true turnover for calendar year 2019. • NTM’s bank statements record credits to the bank account for the period 1 January 2019 to 31 December 2019 of £4,765.10. • Accounts for NTM for the periods ending 30 November 2019 (approved by Mr Marara on 1 June 2020) and 30 November 2020 appear to show that NTM did not receive any credits from trading activities in 2019. • Based on credits into NTM’s bank of £4,765.10, NTM would not have been entitled to a BBL and therefore received £50,000 more than it was entitled to. • On 27 July 2020 NTM received the BBL funds of £50,000. • Between 29 July 2020 and 4 November 2020, transactions were made from NTM’s bank account totalling £34,520.50 which did not provide economic benefit for the company NTM. • No repayments were made by NTM in respect of the BBL. • NTM entered Creditors Voluntary liquidation on 27 July 2022. Total estimated liabilities at liquidation amounted to £52,887 of which £50,000 related to the amount owed in respect of the BBL.
