Conduct: On 15 June 2020 Mr Dumitru Muntean (“Mr Muntean”) caused Muntean Interstyl Ltd (“MIL”) to apply for a Bounce Back Loan (“BBL”) of £50,000, by overstating the company’s turnover. As a result, MIL received more than it was entitled to from the BBL scheme. Furthermore, BBL funds obtained do not appear to have been used for the economic benefit of MIL, as was required by the terms of the BBL scheme. • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated annual turnover from the date the business started; • MIL was incorporated on 25 October 2016 and started to trade immediately. MIL’s accounts for the years ended 31 October 2019 and 31 October 2020 disclose turnovers of £32,921 and £47,026 respectively; • On 15 June 2020 Mr Muntean applied for a BBL of £50,000 on behalf of MIL declaring that its annual turnover was £200,000. MIL received the BBL funds of £50,000 on 17 June 2020; • Following receipt of the BBL, in the period from 17 June 2020 to 22 September 2020, the full sum of £50,000 in BBL funds received were disbursed in various payments. Mr Muntean has not provided any explanations or evidence to show that these payments were for the economic benefit of MIL; • Total liabilities at liquidation were £51,325, including £50,525 owed to the bank in respect of the BBL obtained.
