Conduct: Robert Lee Walker (“Mr Walker”) failed to ensure that Ulta Build Construction NE Limited (“UBCNE”) complied with its statutory obligations to submit returns and payments to HM Revenue and Customs (“HMRC”) as and when due from at least 7 January 2019. Mr Walker also caused UBCNE to trade to the detriment of HMRC from at least 7 January 2021 to liquidation on 19 October 2023 in respect of VAT. VAT • Assessments were raised by HMRC for periods ending November 2018 to November 2019 and February 2022 to October 2023. • Returns for periods ending November 2020 to November 2021 were submitted to HMRC totalling £54,268. • No payments were made to HMRC in respect of VAT from at least 11 January 2019. • At the date of liquidation, £194,047 remained outstanding to HMRC in respect of VAT including surcharges and penalties. Comparative Treatment • Bank statement analysis for the period 7 January 2021 to liquidation show £2,183,270 were debited from the company’s bank account of which £542,437 (net £482,489) was paid to the director in the form of salary, loans and other benefits. During that same period £1,130,216 were paid to trade creditors. No monies were paid to HMRC. • At liquidation, UBCNE had creditors totalling £297,020 of which £ 271,237 was owed to HMRC.
