Conduct: On 31 May 2020, Bartosz Jedrysiak (“Mr Jedrysiak”) caused WPB Transport Ltd (“the Company”) to apply for a Government backed Bounce Back Loan (“BBL“) declaring turnover that he knew or ought to have known was overstated resulting in the Company obtaining a BBL of £50,000 which was approximately £41,410 more than it was entitled to. in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. Applicants that had been established before 01 January 2019 were required to provide a turnover figure for the 2019 calendar year; applicants established after 01 January 2019 were entitled to apply for a BBL of up to 25% of estimated annual turnover from the date the business started. • The Company was incorporated on 7 October 2016 and started trading on incorporation. • Mr Jedrysiak was appointed as the sole director from 7 October 2016 to liquidation. • Accounts for the year ending 30 September 2019 record turnover of £22,067. • Accounts for the year ending 30 September 2020 record turnover of £34,360. Based on this figure, the company was entitled to apply for a BBL of £8,590. • On 31 May 2020, Mr Jedrysiak applied for a BBL of £50,000 declaring the Company’s turnover was £200,000. • The BBL £50,000 proceeds were received into the Company’s bank account on 2 June. • Between 2 June 2020 and the date of liquidation, payments totalling only £10,646 were made in reduction of the BBL. • A Proof of Debt filed in the liquidation states that £42,451.53 is owed to the bank by the Company in respect of the BBL.
