Conduct: Dimitar Velev (“Mr Velev”) caused DNK Velev Ltd (“the Company”) to trade to the detriment of His Majesty’s Revenue and Customs (“HMRC”) in respect of VAT from 07 May 2020 to 13 November 2024 being the date of liquidation by winding up order such that HMRC were owed £101,166.70 inclusive of penalties and surcharges. VAT • VAT return submitted for period ending 31 March 2020 shows an amount of £4,581.93 was due for that period which remained outstanding at the time of liquidation. Prior to this return the company VAT was up to date. • VAT return submitted for period ending 30 June 2020 shows an amount of £8,494.08 was due for that period. This was settled in full in monthly instalments from 11 January 2021 to 09 December 2021 through the Covid-19 VAT deferral scheme. • VAT return for period ending 30 September 2020 shows an amount of £7,132.13 was due for that period of which £3,132.13 remained outstanding at liquidation. • VAT returns for periods ending 31 December 2020 to 31 March 2024 shows amounts of £86,429.76 due for those periods which remained outstanding at liquidation. • Mr Velev arranged a Time to Pay (“TTP”) agreement with HMRC on 27 March 2023 where he would pay £1,000 per month for 3 months. The TTP was paid in full plus an additional £1,000 which was applied to the VAT account on 20 April 2023. • The TTP monies were applied against the return for period ending 30 September 2020 • VAT surcharges, interest and penalties totalling £7,022.88 were raised by HMRC which remained outstanding at liquidation. • At the date of liquidation £101,166.70 remained outstanding to HMRC in respect of VAT including penalties and surcharges. Comparative treatment • Analysis of the company bank statements for the period 07 May 2020 to the closure of the account on 24 October 2024 shows that £872,980.37 was credited to the account and £872,980.37 was debited from the company, of which at least £222,276.95 net was paid to trade and expense creditors, at least £455.619 was paid to employees and subcontractors, and at least £103,633.45 net was paid to the director. • During the same period £17,620.03 was paid to HMRC, of which £5,125.95 was for returns due prior to the period of the allegation.
