Conduct: Callum Henry Jones (“Mr Jones”) caused Colourcoat Ltd (“Colourcoat”) to contravene regulation 21 and 24 of the Privacy and Electronic Communications Regulations 2003 (“PECR”). In that: •Between 1 August 2019 to 31 March 2020, Colourcoat used public telecommunications services for the purposes of making a total of 969,273 connected unsolicited calls for direct marketing purposes. •Of these calls 452,811 calls were made by Colourcoat to subscribers who had opted out of receiving such calls by registering with the Telephone Preference Service (“TPS”). Each of those calls was in breach of Regulation 21 of PECR. •These calls resulted in 24 complaints about unsolicited direct marketing calls being made to the TPS and 10 complaints to the Information Commissioners Office (“ICO”). •Colourcoat made repeat call to subscribers who had informed Colourcoat that they did not wish to receive such calls, in Breach of regulation 21 of PECR. •Colourcoat used numbers on which the recipients of the calls could not contact Colourcoat, in Breach of regulation 21 of PECR. •Colourcoat used various false company names and/or did not identify itself, in breach of Regulation 24 of PECR. •Following an investigation the ICO issued Colourcoat with an Enforcement Notice and Monetary Penalty Notice dated 16 June 2021, informing the company that a penalty of £130,000 was to be levied against it. •Between 7 December 2022 and 16 December 2022 Colourcoat made payments totalling £74,238 towards the fine levied by the ICO. •Colourcoat was placed into Liquidation on 7 June 2023. At that date Colourcoat had liabilities of £105,437 consisting of £55,673 to the ICO and £49,764 for a Bounce Back Loan.
