Conduct: Mark Russell (“Mr Russell”) caused Alban Homes Nominee Ltd (“AHN”) to apply for a Bounce Back Loan (“BBL”) in the sum of £50,000 on 17 June 2020 using an overstated turnover figure in the BBL application form. Consequently, AHN received more monies than it was entitled to from the BBL scheme, in that: • Businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover in the calendar year 2019. • AHN was incorporated on 08 September 2016. • On 17 June 2020 Mr Russell applied for a BBL in the sum of £50,000 on behalf of AHN declaring that its turnover was £1,000,000. • On 18 June 2020 the BBL, in the sum of £50,000, was paid into AHN’s Bank Account. • Professionally prepared accounts for AHN show that the company’s turnover for the year ended 30 September 2019 was £22,000. These accounts were approved by Mr Russell and filed at Companies House on 23 April 2021. Professionally prepared accounts for the year ended 30 September 2020 show that the turnover was £87,120. These accounts were approved by Mr Russell and filed at Companies House on 23 April 2021. Whilst these finalised accounts were not available to Mr Russell at the date of the BBL application, they show that the maximum turnover for AHN in the calendar year 2019 was £109,120. • Accordingly, AHN was eligible for a BBL in the maximum sum of £27,280 and received at least £22,720 more than it was entitled to under the BBL scheme. • Bank records show that AHN’s income for the calendar year ending 31 December 2019 was no more than £41,269. • On 13 February 2023 AHN entered Creditors Voluntary Liquidation with total liabilities of £57,563 of which £50,821 relates to the outstanding BBL.
