Conduct: On 17 November 2020 Mr Naeem Tahir ("Mr Tahir") caused Phoenix Plumbing & Heating Ltd ("PP&HL") to apply and obtain a Government backed Bounce Back Loan ("BBL") in the sum of £49,500 by overstating its turnover on the BBL application resulting in PP&HL receiving more funds from the BBL scheme than it was entitled to. In that: • Where a business was established before 01 January 2019, it was entitled to apply for a BBL of between £2,000 and £50,000 up to a maximum of 25% of turnover for the calendar year ended 31 December 2019. • PP&HL was incorporated on 23 August 2016 and began trading in 2016. The applicant was therefore required to declare PP&HL's actual turnover for the period 01 January 2019 to 31 December 2019 in the BBL application; • The BBL application submitted on behalf of PP&HL by Mr Tahir declared that its turnover for 2019 was £210,000 and applied for a BBL in the sum of £49,500; • Financial statements for PP&HL record that its turnover for years ended 31 August 2019 and 31 August 2020 was £42,080 and £59,477 respectively. • PP&HL's bank statements record that it received receipts totalling £32,360.15 during calendar year 2019. Turnover in the sum of £32,360.15 would have entitled PP&HL to a maximum BBL in the sum of £8,090.04. • By over-stating turnover in PP&HL's application, the Company obtained £41,409.96 more in BBL funds than the Company was entitled to receive; • PP&HL entered Creditors’ Voluntary Liquidation on 26 July 2023 • At the date of liquidation, the sum of £47,434 remained owing to the Bank in respect of the outstanding BBL. • The Bank has confirmed that the sum of £47,791.97 remained outstanding in respect of the BBL.
