Conduct: On 05 June 2020, Brendan Lynch (“Mr Lynch”) caused BL Construction Services Ltd (“BLCS”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating turnover, resulting in the company receiving a loan of £50,000 which was more than it was entitled to, in that: Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019, it was 25% of the estimated annual turnover from the date the business started. BLCS was incorporated on 30 June 2016 and began trading around that time. On 05 June 2020 Mr Lynch applied for a BBL on behalf of BLCS and stated on the BBL application form that the company’s turnover for the 2019 calendar period was £2.5 million. BLCS’ bank statements for the 2019 calendar period show turnover of no more than £113,172, which means that the company was entitled to a BBL of £28,293. On 05 June 2020 BLCS received £50,000 in respect of the BBL, which was £21,707 more than it was entitled to. BLCS entered liquidation on 30 March 2023 with liabilities of at least £74,388 of which £41,308 relates to the BBL.
