Conduct: On 26 May 2020 Agron Ukeperaj (“Mr Ukeperaj”) caused A U Builders Ltd (“A U Builders”) to apply for a government-backed Bounce Back Loan (“BBL”) of £50,000 using overstated turnover figures, when he knew, or ought to have known, that A U Builders was only eligible for a loan to a maximum amount of £11,950, in that: • Under the BBL scheme a business was able to borrow up to 25% of its turnover in calendar year 2019, up to a maximum of £50,000 and, if the business was established after 1 January 2019, it was to apply the 25% limit to its estimated annual turnover from the date it started. The turnover figure was self-certified by the applicant. • A U Builders was incorporated on 28 June 2016 and commenced trading on the same date. • Mr Ukeperaj was appointed as sole director on 28 June 2016 and remained so until Liquidation. • On 26 May 2020, Mr Ukeperaj applied for a BBL of £50,000 on behalf of A U Builders, stating in the loan application that A U Builders’ relevant turnover was £224,103. • Company Accounts for the Years Ended 30 June 2019 and 30 June 2020 declare turnover as £31,365 and £47,800 respectively. • On or around 28 May 2020, funds of £50,000 were credited to A U Builders’ bank account. • A U Builders therefore received BBL funds of at least £38,050 more that it was entitled to. • At the date of the liquidation on 29 February 2024, the Statement of Affairs shows that total liabilities amounted to £65,497.38, of which £49,043 was in respect of the BBL.
