Conduct: On 03 September 2020 Nikolay Hristov Kolev (“Mr Kolev”) caused Kaicony 2 Limited (“Kaicony”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover on the BBL application, as a result Kaicony received more funds than it was entitled to from the BBL scheme. In that, 1 Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the application. The turnover figure required was that for the calendar year 2019, or where a business was established after 01 January 2019 it is their estimated annual turnover from the date that the business was started. 2 Kaicony was incorporated on 31 May 2016. 3 On 03 September 2020 Mr Kolev signed a BBL agreement on behalf of Kaicony for an amount of £50,000 declaring that its turnover was £210,000. 4 Kaicony’s accounts for the periods ending 31 May 2019 and 31 May 2020 record total turnover to be £23,702. 5 Kaicony’s bank statements for the 2019 calendar year show receipts totalling £12,815, and therefore based on this turnover Kaicony was entitled to a maximum BBL of £3,204. 6 By making an application to borrow £50,000 Kaicony received a BBL of at least £46,796 more than it was entitled to. 7 On 04 September 2020 Kaicony received the BBL funds of £50,000 into its bank account. 8 Kaicony made repayments of £5,594 towards the BBL. 9 Kaicony entered Creditors Voluntary liquidation on 18 December 2022. Total liabilities at liquidation amounted to £52,156 of which £45,000 related to the amount owed in respect of the BBL.
