Conduct: On 28 August 2020, Joseph Dixon (“Mr Dixon”) caused J D Holdings (NE) Ltd (“JDH”) to apply for a Bounce Back Loan (“BBL”) of £50,000 to which it was not entitled to and caused the JDH to transfer £49,980 of the BBL funds for purposes that did not provide economic benefit to JDH in that: Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 1 January 2019 it is their estimated turnover. JDH was incorporated on 27 May 2016. On 28 August 2020, Mr Dixon applied for a BBL of £50,000 on behalf of JDH declaring that its turnover for the calendar year 2019, or estimated annual turnover was £300,000. The BBL agreement was signed by Mr Dixon on 28 August 2020. Accounts for JDH record the company had been dormant prior to the period ending 31 May 2018 Accounts for JDH for the period ending 31 May 2019 record no turnover for the trading period. Accounts for JDH for the period ending 31 May 2020 record no turnover for the trading period. JDH’s bank account only became active on the receipt of the BBL. The company traded from 1 June 2020 until 30 April 2022. During that time the only monies paid into the account were the BBL funds. On 30 August 2020 JDH received the BBL funds of £50,000. Between 30 August 2020 and 23 November 2020 sums totalling £49,980 were transferred to an associated company which Mr Dixon was an appointed director and shareholder. These payments did not provide economic benefit to JDH. JDH entered into Creditors Voluntary liquidation on 3 May 2022. Total liabilities at liquidation amounted to £56,130 of which £49,990 related to amount owed in respect of the BBL.
