Conduct: Mr Diar Najmaden Mohammed (“Mr Mohammed”) breached his duties whilst acting as a director of Daren (Bristol) Limited (“DBL”) by failing to ensure that it complied with its legislative requirements, In that: • Home Office Immigration Enforcement (“HOIE”) carried out a visit to the trading premises of DBL on 29 August 2023 and as a result, issued a Notification of Liability for Civil Penalties (“civil penalty”) on 07 May 2024 amounting to £30,000 in respect of the employment of 3 workers, payment of which was due on or before 06 June 2024. • Mr Mohammed has failed to provide sufficient records to evidence that DBL carried out proper checks in compliance with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 (“the 2006 Act”) resulting in the employment of 3 people who did not have the right to work or the right to work for the tasks they were performing. Mr Mohammed was the sole director of the company at the time of the breaches of the 2006 Act. • On 05 June 2024, HOIE rejected an appeal from DBL into 3 illegal workers and the penalty of £30,000 stood, with payment expected on or before 05 July 2024. • Between 05 June 2024 and 16 September 2024, Mr Mohammed caused DBL to make payments of £42,000 to himself, of which £25,000 was paid on the day DBL ceased trading, at a time when he knew that a civil penalty had been issued by HOIE. • DBL did not make any payments to HOIE in respect of the outstanding civil penalty.
