Conduct: Sheikh Thufael Islam (“Mr Islam”) caused T I Enterprise Limited (“TIE”) to make false representations in an application for a Government backed Bounce Back Loan (“BBL”) of £25,000 and failed to use the BBL for the economic benefit of the company, in that: • The BBL scheme allowed businesses affected by the Coronavirus pandemic to apply for a government backed loan of between £2,000 and £50,000, up to a maximum of 25% of turnover in the calendar year 2019. • According to TIE’s own records, it ceased trading in February 2020 • On 17 May 2020, Mr Islam applied for a BBL of £25,000 on behalf of TIE. In the BBL application form, Mr Islam declared TIE’s turnover for the calendar year 2019 to be £104,672. • TIE’s accounts for the year ended 31 May 2019 showed turnover of £28,925 and for the year ended 31 May 2020 showed turnover of £47,745. This indicates that turnover was overstated in the BBL application by at least £56,927. • As a result of the overstatement of turnover, TIE was granted a BBL of at least £13,064 more than its qualifying turnover. • On 19 May 2020, the BBL funds of £25,000 were paid into TIE’s bank account. • Between 19 May 2020 and 20 May 2020, Mr Islam made payments of £9,876 from BBL funds for personal credit card liabilities. • On 20 May 2020, Mr Islam paid £13,616 of the BBL funds to himself. • On 12 November 2021, TIE went into liquidation and the Statement of Affairs shows that the BBL of £25,000 remained outstanding at that date.
