Conduct: In the period 07 October 2021 to 16 December 2023 (“the period”), Nick Robinson (“Mr Robinson”) caused Lifttech Engineering Ltd (“Lifttech”) to trade to the detriment of HM Revenue & Customs (“HMRC”) in respect of Value Added Tax (“VAT”) by failing to make payments as and when they fell due resulting in a VAT liability at liquidation of at least £357,274: VAT • Lifttech was registered for VAT with HMRC on 01 July 2017. Lifttech was required to account for its VAT from that point. As sole director from 01 September 2019, Mr Robinson was responsible for ensuring that Lifttech’s tax affairs were in order. • According to HMRC Ledgers, during the period, Lifttech submitted VAT returns to HMRC for the quarters ended 31 August 2021 to 31 August 2023. These returns fell due for payment from 07 October 2021 onwards and show an amount due to HMRC of £357,274, together with surcharges of £50,597 and penalties of £980. • HMRC ledgers detail no payments received from Lifttech in respect of VAT. Comparative Treatment • Between 07 October 2021 and 16 December 2023 Lifttech’s bank statements show income received totalled £2,749,291 and expenditure which totalled £2,800,133. Payments out included £1,782,368 to trade creditors, £370,712 to employees, £165,295 for company expenses, a net outflow of £177,833 paid to Mr Robinson and connected parties, £9,215 cash withdrawals and £294,710 in respect of PAYE. Lifttech’s bank statements do not show any payments made to HMRC in respect of Lifttech’s VAT liability. • At liquidation, Lifttech had liabilities outstanding of £20,448 to trade creditors, £43,794 to the bank, and at least £357,274 to HMRC in respect of VAT.
