Conduct: On 31 August 2020, Mr Octavian Ciochina (“Mr Ciochina”) caused Octav Limited (“Octav”) to apply for a government-backed Bounce Back Loan (“BBL”) of £45,000 using overstated turnover figures, when he knew, or ought to have known, that Octav was only eligible for a loan to a maximum amount of £11,347, in that: • Under the BBL scheme a business was able to borrow up to 25% of its turnover in calendar year 2019, up to a maximum of £50,000 and, if the business was established after 1 January 2019, it was to apply the 25% limit to its estimated annual turnover from the date it started. The turnover figure was self-certified by the applicant. • Octav was incorporated on 9 May 2016 and commenced trading the following month. • Mr Ciochina was appointed as sole director on 9 May 2016 and remained so until Liquidation. • On 31 August 2020, Mr Ciochina applied for a BBL of £45,000 on behalf of Octav, stating in the application that Octav’s relevant turnover was £195,000. • Mr Ciochina states that a 3rd party helped him with this BBL application, though there is no evidence of this. • Company accounts for the Years Ended 31 May 2019 and 31 May 2020 declare turnover as £45,388 and £37,552 respectively, therefore based on the higher of these two figures, the maximum BBL that could be obtained was £11,347. • On 2 September 2020, funds of £45,000 were credited to Octav’s bank account. • Octav therefore received BBL funds of at least £33,653 more that it was entitled to. • At the date of the liquidation on 18 July 2024, the Statement of Affairs shows that total liabilities amounted to £48,720, of which £44,120 was in respect of the BBL.
