Conduct: During the period 28 April 2016 to 16 March 2018, (the date of Liquidation) Michael Ross (“Mr Ross”) failed to ensure that Goldman Reeves Ltd (hereinafter “Goldman”) maintained and/or preserved adequate accounting records and/or in the alternative failed to deliver up such accounting records as were maintained, in that:

  • Bank statements for the period 1 July 2016 to 1 November 2017 show receipts of $49,644.63(US Dollars) and withdrawals or debits totalling $37,761.80.The purpose of the transactions between 1 July 2016 and 1 November 2017 cannot be evidenced.
  • $24,894.02 was in the aforementioned account on 30 November 2017 and the way in which these funds were applied cannot be determined
  • It is not possible to determine whether any monies were received by Goldman between 12 November 2017 and 16 March 2018
  • It is not possible to determine the identity and number of clients for whom Goldman acted
  • It is not possible to determine a full list of parties with whom Goldman sought to collect or collected monies on behalf of its clients.
  • It is not possible to confirm that Goldman complied with UK legislation in respect of debt collection.
  • It is not possible to determine whether there are any assets, including antecedent recoveries, which can be realised for the benefit of creditors
  • It is not possible to determine the extent of any taxation liability to HM Revenue & Customs incurred in respect of Goldman’s trading
  • It is not possible to determine the full extent of Goldman’s liabilities
  • On 28 March 2018 Goldman was wound up by the Court in the public interest, with the grounds in the petition summarised as: o trading with a lack of transparency/lack of stewardship, o trading with a lack of commercial probity, o failure to co-operate and o carrying out regulated activities without authorisation by the Financial Conduct Authority Furthermore, Goldman’s website stated that clients’ personal information was secure and protected by a cybersecurity provider. However the cybersecurity provider has confirmed to the Official Receiver that they had no contract with Goldman. Any party who entered personal information via the website had therefore been misled in respect of its protection.
