Conduct: On 05 May 2020 , Konstantinos Karvounopoulos (“Mr Karvounopolous”) caused Atlas Transport Ltd (“Atlas”) to apply for a government backed Covid Bounce Back Loan (“BBL”) when he knew or ought to have known that the turnover stated in the application was overstated. Furthermore, Mr Karvounopolous allowed Atlas to apply for a second BBL on 03 July 2020 when only one loan was allowed. In that: • Atlas was incorporated on 29 March 2016. • Mr Karvounopoulos was appointed as a joint director from incorporation until Liquidation. • Under the BBL scheme rules, a company that was carrying on business on 01 March 2020 was eligible for one BBL of 25% of its 2019 calendar year turnover, up to a maximum of £50,000. When making an application for a BBL, an applicant had to self-certify the company’s 2019 calendar year turnover. Where a company commenced trading after 01 January 2019, the applicant was entitled to provide a reasonable estimate of Company annual turnover from the date it started business. • Atlas was not eligible to predict its turnover. • Accounts for the year ending 31 March 2019 record turnover of £145,657 • Accounts for the year ending 31 March 2020 record turnover of £45,004 • Income received into Atlas’s bank accounts for 2019 amounted to £101,932.68, resulting in Atlas being eligible for no more than £25,483 in BBL funding. • On 05 May 2020, Mr Karvounopoulos applied to Bank A for a BBL of £36,250, being £10,000 more than Atlas was eligible for, having declared turnover of £145,000. BBL1 proceeds were received into the bank account on 02 June 2020. • On 03 July 2020, Mr Karvounopoulos’s co-director applied to Atlas’s Bank B for a BBL of £40,000 stating that Atlas’s turnover was £180,000. BBL2 proceeds were received into the bank account of Bank B on 06 July 2020. • Atlas was not entitled to apply for BBL2. • At liquidation the sum of £5,011.33 had been repaid in relation to BBL1and £1,264.00 had been repaid in relation to BBL2.
