Conduct: That, between at least 20 August 2016 and 05 October 2016, Paul James Owens (“Mr Owens”), at a time when he knew or ought to have known that The Moorcroft Motor Company Limited (“Moorcroft”) was unable to supply a prepaid vehicle to an existing customer, caused Moorcroft to continue to take payments in full for 6 vehicles from 5 customers, which it failed to supply to those customers, resulting in a loss of £78,049, including court costs of £675, to those customers in that:

  • On 20 August 2016, Moorcroft failed to supply a vehicle to customer A as agreed. This vehicle had been sold for £8,302 on 13 August 2016 and the customer had made payment in full on 16 August 2016 into Moorcroft’s bank account. Customer A is owed £8,610 including court costs; Between 20 August 2016 and 05 October 2016
  • On 22 August 2016, customer B made payment in full of £11,350 into Moorcroft’s bank account in respect of a vehicle sold by Moorcroft on 17 August 2016. The vehicle was not supplied to customer B and they are owed £12,100 including court costs;
  • On 23 August 2016, customer C made payment in full of £19,684 into Moorcroft’s bank account in respect of a vehicle sold by Moorcroft on 20 August 2016. The vehicle was not supplied to customer C and they are owed £19,684;
  • The advertisement for the vehicle purchased by customer C stated that Moorcroft owned the vehicle, however when customer C said they would collect the vehicle after Moorcroft had failed to deliver it, they state they were informed by Mr Owens that Moorcroft did not own the vehicle and it had not been bought.
  • On 25 August 2016, customer D made payment in full of £14,520 into Moorcroft’s bank account in respect of a vehicle sold by Moorcroft on 25 August 2016. The vehicle was not supplied to customer D and they are owed £15,714 including court costs;
  • On 26 August 2016, as a result of Moorcroft’s failure to supply customer A’s vehicle, they cancelled their purchase and requested repayment in full. On 27 August 2016, Mr Owens advised customer A that the refund had left Moorcroft’s bank account on 26 August 2016.
  • Between 27 August 2016 and 12 September 2016, customer A pursued Moorcroft further as they had not received any refund as stated by Mr Owens. On 09 September 2016 and 12 September 2016, Mr Owens provided customer A with documentation showing a repayment of £8,200 was made from Moorcroft’s bank account to customer A on 26 August 2016. Customer A did not receive this payment and it is not recorded in Moorcroft’s bank statements which have been provided by the bank.
  • On or around 15 September 2016 and on 27 September 2016, customer E made two payments in full of £8,560 and £10,660 in respect of two vehicles sold by Moorcroft on 15 September 2016 and 19 September 2016. The first payment was made into an unidentified bank account and the second payment was made into Moorcroft’s bank account. These vehicles were not supplied to customer E and they are owed £19,220;
  • On or around 05 October 2016, customer F made payment in full of £12,600 into an unidentified bank account in respect of a vehicle sold by Moorcroft on 05 October 2016. The vehicle was not supplied to customer F. A partial repayment of £2,600 was made to customer F from Moorcroft’s bank account on 09 November 2016 and customer F is owed £11,331 including court costs. That from incorporation on 15 March 2016 to the date of liquidation on 06 January 2017, Paul James Owens (“Mr Owens”) failed to ensure that the Moorcroft Motor Company Limited (“Moorcroft”) maintained and/or preserved accounting records or in the alternative, he failed to deliver up such accounting records for Moorcroft as a consequence of which:
  • Transfers totalling £244,635 to an unidentified bank account are not accounted for;
  • Payments totalling £977,159 to named recipients are not fully accounted for;
  • Cash withdrawals totalling £12,400 are not accounted for;
  • Transfers totalling £10,000 to Mr Owens are not accounted for;
  • Transfers totalling £366,159 from an unidentified bank account are not explained;
  • Deposits totalling £841,723 from named payers are not fully explained;
  • Transfers totalling £60,345 from Mr Owens are not explained;
  • Full details of all vehicle purchases and sales made by Moorcroft and the bank accounts through which all its transactions were processed cannot be established and its total sales receipts are both unknown and not fully accounted for.
