Conduct: On 26 June 2020 Mr Stelian Dumitru (“Mr Dumitru”) breached the terms of the Bounce Back Loan Scheme by causing ACR Trans Ltd (“ACR Trans”) to overstate its turnover on its application for a Bounce Back Loan (“BBL”) resulting in the company receiving a BBL of £50,000 when he knew or ought to have known that ACR Trans was not eligible for a loan of this amount. Furthermore, Mr Dumitru failed to ensure that the entirety of the BBL funds were used for the economic benefit of ACR Trans, in that:  • The BBL scheme rules allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which those businesses would self-certify when completing the BBL application. It was a condition of the BBL scheme that funds were to be used for the economic benefit of the business. • ACR Trans was incorporated on 7 March 2016 • The company’s Annual Accounts for financial year ending 31 March 2019 and 31 March 2020 show ACR Trans achieved a turnover of £25,787 and £48,178 respectively.   • Bank statements show that between 18 January 2019 and 31 December 2019, the company received income of £49,075. • Mr Dumitru declared on the company’s BBL application form on 26 June 2020 an annual turnover of £200,100 and applied for £50,000. This was paid into the bank account on 06 July 2020. • Based on the income into the bank account for the 2019 calendar year, the company was entitled to a maximum BBL of £12,269 and therefore received £37,731 more in BBL funding than it was entitled to. • Between 10 July 2020 and 28 August 2020 payments totalling £45,017 were made to Mr Dumitru. No evidence has been provided to confirm that any of these payments were for the economic benefit of ACR Trans. • At liquidation, liabilities totalled £71,445 of which £32,936 was owed to the Bank in respect of the BBL.
