Conduct: David Austin Fox (“Mr Fox”) failed to ensure that AM Home Design Limited ("AMHD") made payments to HM Revenue & Customs ("HMRC") as and when due and caused AMHD to trade to the detriment of HMRC in respect of Pay-As-You-Earn ("PAYE") and National Insurance ("NI") from at least 22 August 2016 and in respect of Value-Added-Tax ("VAT") from at least 07 April 2017 until the date of liquidation on 14 November 2017. As a result, at least £97,133 was due to HMRC at the date of liquidation. In that: PAYE/NIC

  • Real Time Information submitted by AMHD for the years 2016/17 and 2017/18 records that between April 2016 and September 2017 PAYE/NIC totalled £56,097 (less employees allowance).
  • Payments from AMHD totalling £11,173 were allocated by HMRC to PAYE/NIC.
  • At the date of liquidation, HMRC was owed £44,924 which had accrued from 22 August 2016 when payment for tax month 4 of 2016/17 was due in full. VAT
