Conduct: Mr Charles Thomas Price (‘Mr Price’) caused The Copyspace Ltd (‘TCL’) to breach the terms and conditions of the bounce back loan scheme by overstating its turnover on a Bounce Back Loan (‘BBL’) application resulting in TCL receiving a larger BBL than it was entitled to, in that: • Annual accounts for TCL for the years ending 28 February 2019 and 28 February 2020 record turnover of £79,100 and £83,450 respectively. • The BBL scheme allowed an applicant to request a loan amount between £2,000 and £50,000 • The terms and conditions of the BBL scheme stipulated that the amount of the loan was based on the turnover of the company, and requested the applicant to: o If the applicant’s business started before 01 January 2019, self-certify the turnover received during the 2019 calendar year o If the applicant’s business started on or after 01 January 2019, provide an estimate of its future turnover for one year from the first date the business started • The loan amount applied for was subject to a maximum of 25% of the self-certified turnover, whether from the 2019 calendar year or an estimate • TCL was incorporated on 23 February 2016 and was not eligible to estimate its income in a BBL application • On 01 July 2020, Mr Price applied for a BBL on behalf of TCL, in which he self-certified that the company had a turnover of £210,000 and requested a loan of £50,000 • As TCL was not entitled to estimate, Mr Price overstated the turnover of TCL in the BBL application, and should have applied for a loan of no more than approximately £20,318 • At liquidation, TCL had liabilities amounting to £137,002 of which £50,000 was owed to the bank in respect of the BBL.
