Conduct: Jevgenijs Panovs (“Mr Panovs”) failed to ensure that GP Builders Limited ("GP") complied with its statutory duties to file returns with HM Revenue and Customs (“HMRC”) in respect of Construction Industry Scheme tax ("CIS") and VAT from the date of his appointment as a director on 14 November 2016 and caused GP to trade to the detriment of HMRC from November 2016 in respect of CIS and May 2017 in respect of VAT until GP's liquidation on 4 December 2017. As a result, HMRC estimated that CIS was outstanding in the sum of £2,379,235 at liquidation and VAT of £21,001. In that: CIS

  • On liquidation GP owed outstanding CIS of £2,379,235 dating back to the period ended 5 November 2016, due for payment by 22 November 2016.
  • No payments were made by GP in respect of its CIS liabilities during the period of his period of directorship and no returns were submitted. VAT
  • On liquidation GP owed outstanding VAT of £21,001 dating back to 03/17, due for payment by 7 May 2017. The last VAT return filed by GP was in respect of the VAT period 12/16, which was filed on 15 March 2017, nearly nine months before liquidation. No returns were filed for the VAT periods 03/17 onwards. On 16 October 2017 HMRC issued a winding up petition against GP, which led to a winding up order being issued on 4 December 2017. At liquidation, HMRC was GP's sole creditor. From 22 November 2016 to GP's liquidation on 4 December 2017, GP's bank statements show that it received payments of £7,190,446 and expended £6,804,544. No payments were made to HMRC in respect of GP's CIS liabilities and only one payment was made to HMRC (for £5,728) in respect of GP's VAT liabilities during that period.
