Conduct: Ayal Kathriarachchi (“Mr Kathriarachchi”) caused Treevalley Limited (“Treevalley”) to breach the terms & conditions of the Bounce Back Loan (“BBL”) scheme by applying for a BBL of £50,000 to which it was not entitled. In that: • The Bounce Back Loan criteria allowed a company to borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover for the 2019 calendar year. • Treevalley was incorporated on 14 January 2016. • On 6 July 2020 Mr Kathriarachchi made a BBL application, declaring turnover to be £300,000. • The BBL of £50,000 was paid into the company bank account on 07 July 2020. • A review of the company bank account between 01 January 2019 and 31 January 2019 shows income received totalling £13,307. The company accounts for the year ending 31 January 2020 show a turnover of £589. • On the basis of the above income Treevalley would have been eligible for a BBL of £3,474 at most. • As at the date of liquidation Treevalley had total liabilities of £39,806 of which £39,706 was in respect of the BBL
