Conduct: On 19 May 2020, Anthony Richardson, (“Mr Richardson”) caused Oxenhope Consultancies Ltd (“Oxenhope”) to apply for a £50,000 Bounce Back Loan (“BBL”) using overstated turnover figures, which Mr Richardson knew or ought to have known was inaccurate or false, as a result Oxenhope received more BBL funds that it was entitled to. In that: • Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of its turnover. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is the estimated turnover from the date the company started the business. • Oxenhope was incorporated on 10 December 2015 and was therefore able to apply for a BBL based on its annual turnover figures for the calendar year 2019. • On 19 May 2020, Mr Richardson applied for a BBL of £50,000 on behalf of Oxenhope. Mr Richardson reported the annual turnover was £202,000. • The £50,000 BBL was paid into the company bank account on 19 May 2020. • Full accounts for the period ended 31 December 2019 show that Oxenhope’s turnover was £51,410. • A BBL could be between £2,000 and £50,000; based on 25% of turnover for 2019, the maximum BBL Oxenhope was entitled to receive was £12,852. • Oxenhope received a BBL which was £37,148 more than it was entitled to. • At liquidation on 02 February 2024, £35,518 of the £50,000 BBL remained outstanding.
