Conduct: Ms Anna Daroy (“Ms Daroy”) caused Globepoint Associates Ltd (“Globepoint”) to breach the terms and conditions of the Bounce Back Loan scheme (“BBL scheme”) in that she caused Globepoint to apply for two BBLs, of £50,000 each, from different lenders and having received the BBL funds caused Globepoint to retain all BBL funds, which remained outstanding at liquidation, in that: • Under the BBL scheme businesses were able to apply for up to 25% of their turnover to a maximum of £50,000. Only one loan was available to businesses and the applicant was required to confirm that it was their only BBL, but businesses which originally borrowed less than the maximum amount available to them under the Scheme were eligible to top-up their original loan. However, the maximum total loan amount was £50,000 and was not to exceed 25% of the business’s turnover. • Ms Daroy applied for a BBL on behalf of Globepoint with Lender A. The application form is undated. • On 4 May 2020, Ms Daroy applied for a BBL of £50,000 on behalf of Globepoint with another lender, Lender B. The BBL funds from Lender B were received on 6 May 2020. • On 9 May 2020, after Globepoint received the BBL funds from Lender B, Ms Daroy signed a BBL agreement on behalf of Globepoint for a loan of £50,000 from Lender A. Globepoint received these funds on 11 May 2020. • Both BBL applications contained a declaration which stated: “I/We confirm that this is my/our only application for a Bounce Back Loan for this business” • Both BBLs remained outstanding at liquidation.
