Conduct: On 18 July 2020 Millicent Dontoh (“Miss Dontoh”) caused Aniconam And Co Ltd (“AAC”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating AAC’s turnover when applying for a BBL. As result AAC received a £50,000 BBL when Miss Dontoh knew or ought to have known that AAC was not eligible for a BBL of that amount. Further Miss Dontoh failed to ensure that the entirety of the BBL funds were used for the economic benefit of AAC, in that: • Under the BBL scheme, businesses could apply for one loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 01 January 2019, an estimated turnover could be used. The terms and conditions of the BBL stated that the loan was to be used to provide economic benefit to the company, wholly for business purposes and not personal purposes. • AAC was incorporated on 18 November 2015, started trading before 01 January 2019, and was therefore not entitled to estimate its turnover for the purpose of the BBL application. • On 18 July 2020, Miss Dontoh applied for a BBL of £50,000 on behalf of AAC declaring that its turnover for calendar year 2019 was £205,000. On 21 July 2020, BBL funds of £50,000 were credited into AAC’s bank account. • Analysis of its bank account shows that between 01 January 2019 and 31 December 2019 AAC received trading related income of £20,500.97. • Based on the income received in its bank account during calendar year 2019, AAC was entitled to apply for a BBL of up to £5,125.24. • The overstatement of turnover meant that AAC received at least £44,874.76 more than it was entitled to from the BBL scheme. • Between 22 Jul 2020 and 01 Sep 2020 payments and cash withdrawals totalling £40,711.11 were made from AAC’s bank account, of which at least £39,253.02 were funds obtained via the BBL scheme, that were not used for the economic benefit of AAC. • AAC entered Liquidation on 28 November 2024 with liabilities totalling £60,500, of which £26,156.75 was owed in respect of the BBL.
