Conduct: Mr Mohammed Alamin Miah (“Mr Miah”) caused Al-Amin Private Hire Limited (“AAPH”) to breach the terms and conditions of the Bounce Back Loan ("BBL") scheme by overstating its turnover in an application to obtain a BBL of £50,000. This resulted in the Company receiving a BBL of £33,734 more than it was entitled to. In addition, Mr Miah failed to ensure all the funds were used for the economic benefit of the business as required. In that: • The BBL application scheme entitled businesses established prior to 01 January 2019 to apply for a BBL in the sum of up to 25% of its turnover in the calendar year 2019. • AAPH was incorporated on 28 September 2015, and it commenced trading around September 2015 • On 13 May 2020 Mr Miah made an application for a BBL. On the application form the Company’s annual turnover was declared to be £214,500. • The Company’s Financial Statements, for the year ended 30 September 2019 state the Company’s turnover to be £65,065. Mr Miah approved the Financial Statements on 30 December 2019, • Based on turnover of £65,065 the Company would have been entitled to a maximum BBL of £16,266. As such the Company received £33,734 more than it was eligible for. • On 14 May 2020 the £50,000 BBL was received into the Company’s bank account. • Between 28 May 2020 and 29 July 2020 payments totalling £21,087 were made to or for the benefit of Mr Miah. There is no evidence these payments, which were funded by the BBL, were for the benefit of the AAPH. • The BBL lender is owed £49,547.52 in respect of the BBL.
