Conduct: On 21 August 2020 Daniel Banayo (“Mr Banayo”) breached the terms of the Bounce Back Loan (“BBL”) scheme by causing ID Greene Ltd. (“ID Greene”) to overstate its turnover on its application for a BBL, resulting in the company receiving a BBL of £50,000 when he knew, or ought to have known that was more than it was entitled to. In that • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. • ID Greene was incorporated on 23 September 2015. • On 21 August 2020, Mr Banayo applied for a BBL of £50,000 on behalf of ID Greene declaring that its turnover for the calendar year 2019 was £210,000. • Accounts dated 30 September 2020 show turnover to 30 September 2019 of £71,885 and turnover to 30 September 2020 of £122,958. • Bank statements show incoming payments during 2019 calendar year of £83,919. Using this figure, ID Greene would have been eligible for a maximum BBL of £20,980. • ID Greene received the BBL funds of £50,000 on 24 August 2020, at least £29,020 more than it was eligible to receive. • Total liabilities at liquidation amount to £74,366 of which £47,162 relates to the amount owed in respect of the BBL.
