Conduct: Ms Fay Stavrinides (“Ms Stavrinides”) caused YK Sparks Ltd (“Sparks”) to trade to the detriment of HM Revenue and Customs (“HMRC”) in respect of Pay As You Earn (“PAYE”) and CIS from 22 May 2019 and Corporation Tax (“CT”) from 01 July 2021 until Ms Stavrinides resigned on 01 October 2022 in that: • Ms Stavrinides was the sole director of Sparks from 18 September 2015 until she resigned 01 October 2022. Pay As You Earn/CIS • Sparks fell into arrears in respect of Pay As You Earn (“PAYE”) from 22 April 2018 when payment for the return to 05 April 2018 fell due. Sparks submitted a return for the period 06 March 2018 to 05 April 2018 in respect of PAYE in the sum of £10,790, which was not paid in full. • Between 22 April 2018 and 22 April 2019 Sparks incurred PAYE/CIS liabilities totalling £88,686, which while not paid on time were paid in full. • For all subsequent periods due from 22 May 2019 until 22 September 2022 PAYE/CIS returns totalling £513,142 were submitted, against which payments totalling £43,917 were made, leaving £469,225 outstanding when Ms Stavrinides resigned. Corporation Tax • At liquidation, Sparks had outstanding corporation tax of £88,308 comprising £37,314 due for the accounting period 01 October 2019 to 30 September 2020, due for full payment on 1 July 2021 and £50,994 for the accounting period 01 October 2020 to 30 September 2021 due for full payment on 1 July 2022. No payments were made to HMRC in respect of Corporation Tax. Differential Treatment • Sparks filed accounts to year ended 30 September 2018 which showed total liabilities of £118,673 of which £0 was owed in respect of liabilities due to HMRC. Filed accounts to 30 September 2021 show total liabilities of £516,928 of which £424,483 was owed in respect of liabilities due to HMRC. • At Liquidation, 15 August 2023, Sparks owed £1,005,887 to creditors. £862,853 of the total liabilities were owed to HMRC, of which £557,533 was incurred and fell due whilst Ms Stavrinides was appointed director.
