Conduct: On 15 July 2020, Linus Dignam (“Mr Dignam”) caused Linus Services Ltd (“Services”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover on a BBL application, resulting in Services receiving more funds than it was entitled to from the BBL, in that: • The Bounce Back Loan criteria allowed a company to borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover in calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. • Services was incorporated on 14 September 2015 and commenced trading from October 2015. • On 15 July 2020, Mr Dignam made an application to a financial institution for a BBL of £50,000 on behalf of Services. • The BBL loan application asked Services to provide details of its turnover for the calendar year 2019. Mr Dignam stated on the application form that the turnover for Services was £200,000. • The prepared accounts for year ended 30 September 2019 show a turnover of £44,513. • The prepared accounts for year ended 30 September 2020 show a turnover of £61,176. • Services was therefore entitled to a BBL of £15,294 at most. • The BBL funds of £50,000 were paid into the company’s bank account on 16 July 2020. Resulting in Services receiving £34,706 more than it was entitled to from the BBL scheme. • Services entered Creditors’ Voluntary Liquidation on 1 September 2023. • At liquidation, Service’s liabilities totalled £51,398 of which £51,286 is due in respect of the outstanding BBL.
