Conduct: Martin Scott (“Mr Scott”) caused Scott and Hayes Limited (“Scott and Hayes”) to trade to the detriment of Her Majesty’s Revenue and Customs (“HMRC”) in respect of Value Added Tax (“VAT”) from 07 August 2016, the date by which any VAT liabilities for the quarter ended 30 June 2016 fell due for payment in full, onwards. By the date of liquidation Scott and Hayes had an outstanding liability of at least £41,797 to HMRC comprising £37,891 in VAT (including surcharges), £3,735 in respect of PAYE/NIC, £154 in respect of Corporation Tax and interest of £17. VAT

  • Scott and Hayes registered for VAT with effect from 01 October 2015;
  • Scott and Hayes did not submit a return for the period ended 30 June 2016 and HMRC raised an assessment in the sum of £6,814 which should have been paid in full by 07 August 2016. Scott and Hayes paid £1,059 against this liability on 11 April 2017 and the balance of £5,755 remained outstanding as at the date of liquidation as did the liability for all subsequent periods;
  • Scott and Hayes submitted no returns for the 3 month periods ended 30 September 2016 and 31 December 2016 and HMRC raised assessments in the sums of £7,467 and £7,143 respectively. Scott and Hayes made no payments whatsoever against the liability which remained outstanding in full as at the date of liquidation;
  • Scott and Hayes did not submit returns for the periods ended 31 March 2017 and 30 June 2017 and HMRC raised an assessment for the 6 month period ended 30 June 2017 in the sum of £15,932. Scott and Hayes made no payments whatsoever against the liability which remained outstanding in full as at the date of liquidation;
  • When HMRC’s claim has been adjusted to remove the assessment for the period ended 30 September 2017, the total outstanding in respect of VAT as at the date of liquidation is £37,891(including surcharges). Differential treatment of HMRC
  • Between 08 August 2016 and 21 September 2017 Scott and Hayes expended £811,976 from the company bank account of which £43,816 was paid to or for the benefit of himself, £14,922 was withdrawn in the form of cash withdrawals from ATM’s and £6,450 was paid to a connected party in the form of loan repayments. During the same period only £1,059 was paid to HMRC in respect of the liability for VAT. A comparison of the creditor position as at the date of the last set of accounts to 30 September 2016 and liquidation shows that the liability to HMRC has increased from £10,165 to £49,610 while the liability to the bank has remained static £25,000 (£24,479) and the liability to trade creditors has reduced from £113,172 to £8,542
