Conduct: Mr Rosen Dimitrov (“Mr Dimitrov”) breached the terms of the Bounce Back Loan (“BBL”) scheme by causing RD Master Ltd (“RD”) to overstate its turnover on its application for a BBL, resulting in the company receiving a BBL of £17,000 when he knew, or ought to have known, that RD was not eligible for a loan of that value, in that: · The BBL scheme terms allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which the applicant would self-certify when completing the BBL application. · If a company was established after 01 January 2019, they were allowed to estimate the company turnover from the date the company started to trade. · RD was incorporated on 20 August 2015. · Mr Dimitrov declared on the company’s BBL application form an annual turnover for 2019 of £70,000, and consequently on 15 June 2020 RD received a £17,000 BBL. · Bank statements for the period 01 January 2019 to 31 December 2019 show total receipts of £357 attributable to business income. · Annual accounts for FYE 31 August 2019 also show a declared income of £357. · This would have meant the company was not eligible to apply for the minimum BBL. · The overstatement of turnover totalling £69,643.00 meant that RD received £17,000 more than it was entitled to from the BBL scheme. · RD entered Creditor’s Voluntary Liquidation on 06 September 2022. · At liquidation, RD had liabilities totalling £21,003.00, of which £17,451.66 was owed to the bank in respect of the BBL.
