Conduct: Mr Jac Connolly (“Mr Connolly”) breached the terms of the Bounce Back Loan (“BBL”) Scheme by causing Mech Ltd (“Mech”) to overstate its turnover on its application for a BBL resulting in the company receiving a BBL of £50,000 when he knew or ought to have known that Mech was not eligible for that amount in that:  • The BBL scheme terms allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which the applicant would self-certify when completing the BBL application. Where a business was established after 1 January 2019, a company was entitled base the 25% limit to its estimated annual turnover from the date it started its business. • Mech was incorporated on 17 August 2015. • Mr Connolly declared on the company’s BBL application form an annual turnover of £205,000 for 2019, and consequently on 19 June 2020 Mech received a £50,000 BBL. • Receipts received into the business bank account for the period 01 January 2019 to 31 December 2019 totalled £62,927.49. • Based on the receipts received in 2019, Mech would have been eligible to apply for a BBL totalling £15,732 at most. • The overstatement of turnover totalling £142,072.51 meant that Mech received £34,268 more than it was entitled to from the BBL scheme. • Mech entered Creditors Voluntary Liquidation on 02 December 2021. • At liquidation, Mech had liabilities totalling £64,655, of which £50,000 was owed to the bank in respect of the BBL. The bank subsequently claimed £48,926.93 in the liquidation.
