Conduct: That Nathan Clarke (Mr Clarke) caused Nathan Clarke Builders Limited (NCB) to trade to the detriment of Her Majestyís Revenue and Customs (HMRC) in respect of Value Added Tax from 07 March 2016, when liabilities for quarter ending January 2016 (q/e 01/2016) fell due for payment and in respect of Pay As You Earn (PAYE), National Insurance Contributions (NIC) and Construction Industry Scheme payments (CIS) from 22 September 2015 when liabilities for the period 06 August 2015 to 05 September 2015 fell due for payment. From 01 January 2016, NCB accrued liabilities in respect of VAT in the sum £143,455. This consisted of £70,951 in respect of returns submitted by NCB, £67,420 in respect of assessments raised by HMRC in respect of returns not submitted by NCB and £5,084 in respect of surcharges raised by HMRC. Against these liabilities, NCB made one payment in the sum of £17,825. At Liquidation on 17 March 2017, HMRC were owed monies in the sum of £125,630 in respect of VAT by NCB. Furthermore, from 06 August 2015, NCB accrued liabilities in the sum of £55,942 in respect of PAYE/NIC/CIS. This consisted of £32,657 in respect of returns submitted by NCB, £18,485 in respect of assessments raised by HMRC and £4,800 in respect of interest and penalties. Against these liabilities, NCB made one payment in the sum of £1,379 and received Employment Allowances in the sum of £4,986. At Liquidation on 17 March 2017, HMRC were owed monies in the sum of £49,577 in respect of PAYE/NIC/CIS by NCB. From 22 September 2015 until Liquidation on 17 March 2017, monies in the total sum of £3,034,474 were paid from the bank accounts operated by NCB with £42,597 being paid in respect of NCBís VAT and PAYE/NIC/CIS liabilities In the same period, monies in the sum of £221,613 were paid to the other creditors of NCB identified in the Statement of Affairs submitted in the Liquidation (SA).
