Conduct: On or around 05 May 2020 Mr David James Reed (“Mr Reed”) caused Medina Construction Limited (“Medina”) to apply for a Bounce Back Loan (“BBL”) of £50,000 when it was not eligible to do so because it was not trading or involved in commercial activity at the date of the application. In that: Under the BBL scheme, businesses were able to apply for a BBL if they were engaged in trading or commercial activity in the UK at the date of the application, were carrying on business on 01 March 2020 and had been adversely affected by Covid. On or around 05 May 2020, Medina applied for a BBL of £50,000. The BBL funds were paid into Medina’s bank account on 06 May 2020. Medina had ceased trading at the date of the application. P45s were issued to Medina’s employees with the leaving date recorded as 13 March 2020, the last income received in Medina’s bank account was on 01 April 2020 and Mr Reed had confirmed in an email dated 03 April 2020 that Medina had ceased trading and staff had been laid off. On 07 September 2022, Medina was wound up in Court based on a petition presented by HMRC on 06 July 2022. At the date of liquidation, £50,000 was owed to the bank in respect of the BBL out of total liabilities of £542,989
