Conduct: Mr Gregory Jermaine Philip (“Mr Philip”) breached the terms of the Bounce Back Loan Scheme by causing GJP Construction Services Ltd (“GJP”) to overstate its turnover on its application for a Bounce Back Loan (“BBL”) resulting in the company receiving a BBL of £45,000 when he knew or ought to have known that GJP was not entitled to apply for a BBL of that amount. Furthermore, Mr Philip failed to ensure the BBL funds were used for the economic benefit of GJP Limited, in that: • The BBL scheme rules allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which those businesses would self-certify when completing the BBL application • The BBL scheme required the funds to only be used to provide economic benefit to the business. • GJP was incorporated on 13 July 2015. • GJP’s annual accounts for the financial years ending 31 March 2019 and 31 March 2020 shows the company achieved a turnover of £74,942 and £78,002 respectively. • On 14 May 2020, GJP applied for a BBL of £45,000. On the application, Mr Philip declared a company turnover of £180,000. • On 18 May 2020, the £45,000 BBL funds were paid into GJP’s bank account. • Between 20 May 2020 and 24 May 2020,the BBL funds were transferred out of GJP’s account in 5 transactions, three payments of £10,000 reference ‘Greg Wages CC Con’ and two payments of £7,500 referenced ‘Dorrett Car’. No evidence has been provided to show that these transactions were for the benefit of GJP. • The bank have submitted a proof of debt in the Liquidation for £23,590.64.
