Conduct: a) Mr Faisal Musakhel (“MR MUSAKHEL”) breached his duties as a director of PORCINI PIZZERIA LIMITED ("PORCINI") by failing to ensure that it complied with legislative requirements in that:

  • PORCINI did not comply with its statutory obligations under The Immigration, Asylum and Nationality Act 2006, resulting in the employment of 1 illegal worker.
  • Home Office Immigration Enforcement (“HOIE”) after investigating PORCINI issued a Notification of Liability for a Civil Penalty of £15,000 in respect of the employment of the illegal worker, payment of which was due on or before 11 August 2017.
  • PORCINI has not paid the fine due to HOIE.
  • he was appointed director of the company at the time of the breach of The Immigration, Asylum and Nationality legislation. b) he failed to ensure that PORCINI submitted accurate VAT returns to HM Revenue and Customs (HMRC) due from the quarter ended February 2016 to the quarter ended March November 2017. In that;
  • HMRC VAT officers visited the premises of PORCINI as they had identified that the sales declared on the company’s VAT returns were less that the sales recorded on merchant acquirer data without including cash sales.
  • HMRC attempted to hold a meeting with him but he failed to attend or reply to subsequent telephone calls. As a result, on 20 April 2018 Officer Assessments were raised in respect of under declared VAT of £41,781for the quarters February 2016 to November 2017.
  • Additionally as a result of the filing of incorrect returns HMRC raised Civil Penalties totalling £10,295 for the quarters February 2016 to November 2017.
  • PORCINI entered Liquidation on 17 May 2018, HMRC’s claim in the Liquidation totalled £94,256 of which £85,432 related to VAT
