Conduct: Since at least 7 July 2015 until 11 May 2018, the date of liquidation, Mr Burzec caused Omega Plumbing Limited (“Omega”) to trade to the detriment of HM Revenue and Customs (“HMRC”) as he failed to ensure that Omega made payments as required for VAT so that as at liquidation, Omega had an outstanding liability of at least £136,112.93 in respect of VAT.

  • Omega’s first return for 09/15 although due for submission and payment by 7 November 2015 at the latest, was submitted on 7 November 2016 for £10,467.56. No payment was made.
  • Omega submitted further VAT returns for the 12/15 to 12/17 periods (albeit not always on time) totalling £87,345.11. No payments were made in respect of these returns. In the absence of adequate payment HMRC raised surcharges totalling £10,789.96 for these periods.
  • In the absence of a return HMRC raised an assessment for the 03/18 period totalling £23,922.00 and applied surcharges of £3,588.30. No payment was made.
  • At Liquidation Omega had VAT liabilities totalling £136,112.93. Comparative treatment: Between 1 July 2016 and 11 May 2018 statements show that, excluding contra entries, £627,239.76 went out of the bank account as detailed below:
  • Payments to/for the benefit of himself as the director totalled £13,932.47
  • Payments in cash, cheques, interest/charges and unknown parties total £73.327.25
  • Payments to a connected party totalled £240,810.44
  • Payments to staff totalled £91,110.00
  • Trade suppliers received £208,059.60, while
  • HMRC received £0 in respect of VAT.
