Conduct: Andrea Louise Pearman (“Ms Pearman”) caused The JAYS E.C Ltd (“JAYS”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover on the BBL application, when Ms Pearman knew or ought to have known that JAYS was not entitled to a BBL of £50,000 and as a result JAYS received more BBL funds than it was entitled to. In that:   • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it is their estimated annual turnover from the date that the business was started. • JAYS was incorporated and commenced trading on 19 May 2015 and as such was required to state its turnover for the calendar year 2019 in the BBL application. • Ms Pearman made a BBL application in the amount of £50,000 on behalf of JAYS declaring turnover of £210,000 and on 03 June 2020 Ms Pearman signed the BBL agreement, with JAYS receiving BBL funds of £50,000 into its bank account on 04 June 2020. • Accounts for JAYS for the years ending 31 March 2019 and 31 March 2020 show turnover of £65,182 and £49,909 respectively. JAYS’ bank statements for the calendar year 2019 show trading receipts of £43,752. Based on JAYS’ turnover for the year ended 31 March 2019, the maximum BBL that should have been applied for was £16,295.50 and JAYS therefore received £33,704.50 more in BBL funding than it was entitled to. • JAYS entered Creditors Voluntary Liquidation on 13 January 2025 with an outstanding BBL of £50,370 including interest charged.
