Conduct: On 26 November 2020, Gerald Pindeni (“Mr Pindeni”) caused Tenrald Limited (“Tenrald”) to obtain a government-backed Bounce Back Loan (“BBL”) of £45,000 using overstated turnover figures, when he knew, or ought to have known, that Tenrald was only eligible for a loan to a maximum amount of £6,084. Furthermore, Mr Pindeni failed to ensure that the funds obtained from the BBL scheme were used for the economic benefit of Tenrald, in that: • Under the BBL scheme a business was able to borrow up to 25% of its turnover in calendar year 2019, up to a maximum of £50,000 and, if the business was established after 1 January 2019, it was to apply the 25% limit to its estimated annual turnover from the date it started. The turnover figure was self-certified by the applicant. • Tenrald was incorporated on 10 April 2015 and commenced trading during 2016. • Mr Pindeni was appointed as one of two directors on 10 April 2015, and he remained a director until Liquidation. • On 26 November 2020, Mr Pindeni applied for a BBL of £45,000 on behalf of Tenrald, stating in the loan application that Tenrald’s relevant turnover was £200,000. • An analysis of the company bank statements from 1 January 2019 to 31 December 2019 (the 2019 calendar year), shows credits totalling £24,333.73 were made to the account, therefore based on this figure, Tenrald was entitled to a maximum BBL of £6,084. • On 30 November 2020, funds of £50,000 were credited to Tenrald’s bank account. • Tenrald therefore received BBL funds of at least £38,916 more that it was entitled to. • It was a condition of the BBL Scheme that all funds were to be used for the economic benefit of the applicant business. • Between 30 November 2020 and 11 December 2020 payments totalling £49,600 were made to Mr Pindeni and a co-director’s personal joint account. No evidence has been provided as to how these payments were used for the economic benefit of Tenrald • At the date of the Winding Up Order on 22 January 2025, the Report To Creditors shows that total liabilities amounted to £48,933.25, of which £43,731.25 was in respect of the BBL.
