Conduct: On 05 May 2020, Mr Hugh Francis Bower (“Mr Bower”) caused Ghost Drinks Ltd (“Ghost”) to make a Bounce Back Loan (“BBL”) application for £50,000 when he knew or ought to have known that Ghost was not eligible for a BBL of that amount under the terms of the BBL scheme, Mr Bower made a wrongful declaration on the BBL application using an overstated turnover figure of £250,000. As a result, Ghost received more BBL funds than it was entitled to, in that: • The terms of the BBL Scheme stated that a business could apply for a loan of up to 25% of the Company’s turnover, from a minimum of £2,000, up to a maximum of £50,000. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated turnover. • Ghost was incorporated on 24 May 2015, commenced trading around May 2015. Ghost was therefore required to provide turnover for the calendar year 2019 when applying for a BBL. • Mr Bower was appointed as sole director between 24 May 2015 to 09 October 2020. • Accounts for the year ending 31 December 2019 record turnover of £101,370. • Analysis of Ghost’s bank account shows that EWI had credits of £116,525 for the calendar year 2019, which would have entitled it to a BBL of £29,131. • On 05 May 2020 Mr Bower applied to the Bank for a BBL of £50,000 having stated in the application form that the turnover was £250,000. • On 07 May 2020, Ghost received a BBL of £50,000, which was £20,869 more than it was entitled to. • At liquidation, the sum of £45,513 remained outstanding in respect of the BBL.
