Conduct: From at least 7 May 2017 to 16 November 2022, the date of liquidation Mark Eastwood (“Mr Eastwood”) failed to ensure that Interior Shopfitters (Kent) Limited (ISL) complied with its statutory obligation in relation to its tax matters and he further caused ISL to trade to the detriment of HM Revenue and Customs (“HMRC”), in that: Value Added Tax (“VAT”) • ISL was registered for VAT scheme with effect from 20 March 2015 with the first VAT quarter being 06/15. The VAT returns for the quarters ended 06/15 to 06/22 were filed with the returns for the quarters ended 09/15 to 06/22 filed late. • The VAT returns filed declared a total VAT liability of £306,987.28 and reclaims of £4,466.76. HMRC raised surcharges totalling £39,331.98. A total payment of £51,376 was made towards the VAT accounts which partially settled the tax liabilities to the VAT quarter ended 03/17, which ought to be paid in full by 07 May 2017. At Liquidation, £294,943.26 remains outstanding in relation to the VAT liabilities. Pay As You Earn, National Insurance Contributions and Student Loan Deductions (“PAYE/NIC/SLD”) • In Liquidation, HMRC’s claim for the outstanding PAY/NIC/SLD liabilities totalled £50,391.48 which covers the 2018/19 tax year to the 2021/22 tax year. The Winding Up Petition presented by HM Revenue & Customs shows the liabilities are due from Month 5 of the 2018/19 tax year, which ought to be paid in full by 22 September 2018. Payments totalling £61,802.13 were made towards the tax accounts. Comparative treatment • ISL’s turnover and bank receipts for the period May 2017 to Liquidation totalled approximately £2,418,988.93, with its expenses and payments totalling approximately £2,374,498.39. The last payment made by ISL on the VAT and income tax accounts was in September 2019. The total payment made to HMRC throughout trading was £113,178.13 (PAYE/NIC/SLD: £61,802.13 and VAT: £51,376). HMRC is the largest creditor in the Liquidation.
