Conduct: Michael Andrew Higgins (“Mr Higgins”) caused Steel Rigging Ltd (“Steel Rigging”) or (“the Company”) to apply for a Bounce Back Loan (“BBL”) of £20,000 on 21 November 2020 using overstated turnover figures in the application form. Consequently, Steel Rigging received £9,212 more monies than it was entitled to from the BBL scheme. Furthermore, Mr Higgins failed to ensure that the BBL funds were used for the economic benefit of the Company, in that: The company traded from March 2018 to November 2021 On 21 November 2020, Steel Rigging obtained a BBL of £20,000 which was at least £9,212 more than it was entitled to. A business could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of its turnover in 2019. In the BBL application, Steel Rigging’s turnover for 2019 was stated to be £80,000; Financial Statements detail that Steel Rigging achieved turnover of £39,930 and £43,152 in the years ended 31 March 2019 and 31 March 2020 respectively; Steel Rigging’s bank statements show total credits of £44,731.30 in the 2019 calendar year; Between 21 January 2021 and 15 February 2021 bank statements show that the £20,000 from the BBL funds were transferred to Mr Higgins and he has provided no evidence to show that these funds were used for the economic benefit of the Company; On 07 December 2021, Steel Rigging entered into Creditor’s Voluntary Liquidation with total liabilities of £23,900, of which £20,000 was the BBL.
