Conduct: In September 2020 Mike Kenny Wacha (“Mr Wacha”) caused Online Real Estate Solutions Ltd (“Online”) to apply for a Bounce Back Loan (BBL) when he knew, or ought to have known, that Online did not meet the criteria for the loan. In that: • The Bounce Back Loan criteria allowed a company to borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover. A company could apply for a loan which was up to 25% of its turnover in the calendar year 2019, from a minimum of £2,000, up to a maximum of £50,000. • The Bounce Back Loan eligibility criteria was that a business was carrying on business at 01 March 2020 and was engaged in trading or commercial activity the UK at the date of the BBL application and had been adversely affected by COVID-19. • Mr Wacha applied for a £25,000 BBL on 28 September 2020, declaring the annual turnover to be £100,000. • Online received £25,000 BBL funds into the company bank account on 29 September 2020. • Online was incorporated on 17 March 2015, and submitted dormant accounts throughout its existence. The company bank statements show that the first transaction was on 29 September 2020 and was the BBL being credited to the account. Therefore, the company was not carrying on business on 01 March 2020 or engaged in trading or commercial activity at the date of the BBL application and was not eligible to receive a BBL • Between January 2022 and January 2023, £10,865 was paid to Mr Wacha. • At liquidation on 22 May 2023, £20,914 of the £25,000 BBL was still outstanding.
