Conduct: On 31 March 2021 Ms Maria Helena De Abreu (‘Ms De Abreu’) applied for and obtained a Government-backed Bounce Back Loan (‘BBL’) of £50,000 for Gaia Hair and Beauty Ltd (‘Gaia’) by providing false or knowingly inaccurate information regarding Gaia’s turnover, thereby causing it to obtain at least £27,303 in BBL funding to which it was not entitled. In that: • The BBL scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019 (or estimated annual turnover from the date it commenced trading if it had been established after 01 January 2019), to a maximum of £50,000; • Gaia was incorporated on 13 March 2015 and commenced trading on or around that date, filing trading accounts for the year ended 31 March 2016 on 03 June 2016 and so it was not permitted to estimate its income for the purposes of the BBL application; • On 17 May 2019 Gaia filed accounts, for the year ended 31 March 2019, showing turnover of £83,470; • The accounts were signed by Ms De Abreu on 12 April 2020; • On 01 April 2021 Gaia filed accounts, for the year ended 31 March 2020, showing turnover of £82,096; • The accounts were signed by Ms De Abreu on 17 March 2021; • Bank statements for Gaia’s’s account show trading receipts of £90,787 in the calendar year 2019; • On 31 March 2021 Ms De Abreu completed an application form for a BBL from Gaia’s bank, self-certifying that its turnover in 2019 was £205,000 and requesting a loan of £50,000. • The BBL was received on 06 April 2021; • Gaia therefore obtained £27,303 in BBL funding to which it was not entitled; • Gaia did not make any instalment payments on the BBL • At the liquidation date £51,108.56 remained outstanding in respect of the BBL.
