Conduct: He caused MJF Facilities Management Limited ("MJF") to trade to the detriment of HM Revenue and Customs ("HMRC") in respect of Value Added Tax ("VAT") from 8 April 2022 (when liabilities for period ended 02/22 fell overdue) and in respect of Pay As You Earn/ Construction Industry Scheme(" PAYE/CIS") from 23 October 2021 until the date that trade ceased on 5 April 2023 in that: • MJF submitted quarterly VAT returns to HMRC for 4 periods ended 02/22 to 11/22 disclosing VAT liabilities due to HMRC totalling £203,992 and HMRC applied a VAT assessment in lieu of a return of £50,299 for the period ended 02/23. • HMRC applied Surcharges totalling £30,752 for the period ended 02/22 to 02/23. • MJF made payments totalling £9,820 on account between 18 November 2022 and 17 March 2023 which HMRC allocated toward the outstanding balance on account. • At liquidation, MJF's VAT liabilities that fell due for payment prior to the date of liquidation totalled £309,324 which included £34,101 incurred prior to 8 April 2022. • Monthly PAYE/CIS returns were submitted for periods ended 5 October 2021, due by 22 October 2021, to 5 April 2023 showing that PAYE/CIS totalling £795,543 was due of which £28,261 fell due for payment after liquidation and is therefore not being criticised. • Payments on account totalling £328,086 were made from 1 November 2021 to 30 January 2023 including payments of £197,474 made as part of a Time to Pay ("TTP") arrangement. • HMRC applied interest and penalties totalling £5,090 • At liquidation MJF's PAYE/CIS liabilities that fell due prior to the date of liquidation totalled £560,552 which included £87,980 due prior to 23 October 2021 and the £28,261 which fell due after liquidation. Differential Treatment • Between the date of the last filed accounts 30 March 2021 to the date of liquidation, MJF's Liabilities to HMRC had increased by £674,829 from £334,578 to £1,009,407. Its liabilities to trade and expense creditors decreased by £504,409 from £681,780 to£177,371 and its liabilities to banks increased by £143,531 from £129,496 to £273,027. • Between 23 October 2021 and 5 April 2023 MJF made payments totalling £6,763,696 from its company bank account.
