Conduct: Michael James Moloney (“Mr Moloney”) caused JMP Environmental Ltd (the “Company”) to trade to the detriment of Her Majesty’s Revenue and Customs (“HMRC”) in respect of Value Added Tax (“VAT”), Corporation Tax (“CT”), Pay As You Earn tax (“PAYE”), Student Loan Deductions (“SLD”) & National Insurance Contributions from at least 22 May 2016 until liquidation and as a result at liquidation HMRC was owed £814,886.31. In that: VAT On 2 May 2016 the Company filed a VAT return for the period ended 06/16 that declared a liability due to HMRC of £26,118.71. The Company paid £9,337.85 against this liability. The balance of £16,780.86 remained due and outstanding at liquidation. The Company filed fifteen returns for the periods ended 07/16, 10/16, 11/16, 12/16, 01/17, 02/17, 03/17, 04/17, 05/17, 06/17, 07/17, 09/17, 10/17, 11/17 & 12/17 that declared a total liability due of £483,387.88. HMRC raised fourteen corresponding surcharges in the total sum of £66,589.36. The Company made no payments and these liabilities remained due and outstanding at liquidation. On 20 December 2016 HMRC raised a penalty of £6,049 in respect of inaccuracies in the filed return for the period ended 11/15. The Company made no payments and this sum remained due and outstanding at liquidation. CT On 18 January 2017 the Company filed late a CT return for the period ended 29 February 2016 that declared a liability due to HMRC of £28,259.00. The Company made payments totalling £16,433.10 leaving £11,825.90 due and outstanding at liquidation. PAYE, SLD & NIC For the tax year 2016/2017 the Company submitted monthly Real Time Information (“RTI”) for months 1 – 12 that declared total liabilities of £266,510.82. The Company made payments totalling £135,968.54 leaving £130,542.28 due and outstanding at liquidation. For the tax year 2017/2018 the Company submitted monthly Real Time Information (“RTI”) for months 1 – 10 that declared total liabilities of £170,446.22. The Company made payments totalling £4,145.83 leaving £166,300.39 due and outstanding at liquidation. Comparative treatment of creditors & apportionment of income Between 22 May 2016 and liquidation payments totalling £6,817,191.75 were made from the Company bank account of which at least £4,024,842.77 was paid to trade creditors, £1,704,527.09 paid to individual persons, £138,591.44 paid to three connected persons, a net £32,059.92 paid to him and £336,834.17 was paid to HMRC. At liquidation submitted creditor claims comprised: (1) HMRC who submitted a claim of £960,404.04 & (2) a former employee of the Company who submitted a claim of £638.
