Conduct: Mrs Chantelle Letheren, (Mrs Letheren) failed to either maintain or preserve adequate accounting records and failed to deliver up such records as were maintained to the Official Receiver as liquidator. In consequence, the liquidator has not been able to satisfactorily quantify, verify and explain all the transactions of Noble Skip Services Limited (“NOBLE”).   • Explain why £71,747 was transferred to her
  • Explain why payments totalling £162,190 were made to a company controlled by a member of her family and payments totalling £57,632 were received from the same company.
  • Determine the true liability for VAT and PAYE
  • Determine the causes of failure She failed to either maintain or preserve and deliver up adequate records relating to the location, storage and transfer of waste in breach of Section 34 (5) of the Environmental Protection Act 1990 and Regulation 35 of the Waste (England and Wales) regulations 2011 in that:
  • A business which operates in the waste industry has a duty of care to dispose of the waste appropriately and is required by Section 34 (5) of the Environmental Protection Act 1990 and Regulation 35 of the Waste (England and Wales) regulations 2011 to retain a written description of the waste for a period of two years from the date of the transfer.
  • No waste transfer records have been delivered up to the liquidator.
