Conduct: On 13 May 2020, Ionut Adrian Lespezanu (“Mr Lespezanu”) caused Universal Drylining Ltd (“Universal”) to breach the conditions of a Bounce Back Loan (“BBL”) by failing to ensure that the entirety of the BBL monies were used for the economic benefit of Universal, in that: On 11 May 2020 the BBL agreement was signed by Mr Lespezanu and on 12 May 2020, the £50,000 BBL funds were paid into Universal’s bank account. When applying for a BBL the applicant had to confirm that the funds would only be used to provide an economic benefit to the business and not for personal purposes. On 13 May 2020 Mr Lespezanu transferred £50,000 to himself from Universal’s bank account, of which at least £48,632 came from BBL funds. Therefore, Mr Lespezanu did not ensure the BBL funds were used for the economic benefit of Universal. On 26 April 2023 Universal entered compulsory liquidation with liabilities of £224,781, £43,149 of which was outstanding in respect of the BBL.
